TERMS AND CONDITIONS
GENERAL CONDITIONS OF THE HOSTELS
This document constitutes the General Conditions of the hostels managed by SMART HOPER, S.L.U. (hereinafter, "LATROUPE"). The General Conditions contain all the information that you (hereinafter, "Hostel Guest" or "Hostel Guests") must know and comply with.
ARTICLE 1. BOOKING CONFIRMATION
Once each reservation has been successfully completed, you, as the Hostel Guest, will receive a booking confirmation with your details and all the information related to it. This booking confirmation represents the agreement between the Hotel Guest and LATROUPE together with these General Conditions, the House Rules, and any other annexes.
ARTICLE 2. ROOMS AND COMMON AREAS AT LATROUPE
For Hostel guests, LATROUPE offers, depending on the accommodation, the following options: Double Room: private room for two with private bathroom and shower. Family Room: private family room for three or four people with private bathroom and shower. Multiple Room: shared/privatised room for 4, 5, 6, 7, 8, 10 or 12 people with ensuite or shared bathroom and shower (depending on the property).
The following amenities are included in each accommodation option: reception, cleaning, air conditioning, Wi-Fi, and a hairdryer available at reception. Towel and bed linen changes are included in double and family rooms. In shared rooms, towels will be charged at an additional cost, and dirty towels must be placed in the boxes available at the reception area when the guest checks out. Hostel guests have free access to the common areas of the facilities. Hostel guests must respect the House Rules when using common areas and the provided equipment. The hostel guest will be charged immediately for misuse and in cases of excessive use.
ARTICLE 3. RATES
LATROUPE offers two rate options: flexible and non-flexible.
Flexible rate: The total amount must be paid at least 24 hours before the scheduled arrival date. Cancellations or modifications to the accommodation are possible up to 24 hours before the arrival date (see Article 7).
Non-flexible rate: The total amount will be charged during the booking process and must be paid immediately. In the event of cancellation, a penalty of 100% of the total accommodation price must be paid (see Article 7).
Municipal tax is added to the prices. The amount of this municipal tax depends on the number of people and the number of nights booked. The prices for the accommodation options listed in Article 2 can be consulted at any time on LATROUPE's website. All amounts are in EUROS. The amount owed by the guest must be paid through the provided online payment system. Prices listed on the website are subject to change. Only the rates in force at the time of booking will apply to the agreement between the Hostel Guest and LATROUPE. Obvious errors (including typos) are not binding. All special offers and promotions are marked as such. If not labelled as such, hostel guests cannot claim entitlement to them in the case of obvious errors or mistakes. Article 8 of these General Conditions applies to group bookings.
ARTICLE 4. ROOM ASSIGNMENT
During the Check-in process, LATROUPE unilaterally assigns a room to the Hostel Guest within the selected accommodation option. Hostel guests may not object to this assignment. LATROUPE reserves the right to assign a different room to a Hostel Guest before or during occupancy for operational reasons. Hostel guests may not object to or demand any compensation from LATROUPE.
ARTICLE 5. ARRIVAL AND DEPARTURE
Check-in can be carried out from the first day of the booking from 3:30 PM onwards. In the event of early arrival, LATROUPE cannot guarantee the availability of the room(s). Check-out must take place on the last day of the booking before 11:00 AM. If a late check-out is required (with a maximum duration of two hours), an additional charge will apply, which will differ per bed in shared rooms or per room in private rooms. After the set time, a full night's accommodation will be charged. If check-out takes place before the scheduled end date of the accommodation, LATROUPE is entitled to charge the total number of reserved nights at the price stated in the booking confirmation. A guest may stay in a dormitory for a maximum of 10 days. After this, the guest must check out of LATROUPE or make a long-stay booking subject to prior agreement with LATROUPE management.
ARTICLE 6. KEY CARD
Upon check-in, the Hostel Guest will be provided with one activated key card per person. At the Hotel Guest's request, one or more additional key cards can be made available upon payment of €10.00 per key card. In the event of loss, damage, or non-return of the key card upon departure, a penalty of €5.00 will be charged.
ARTICLE 7. CANCELLATION POLICY
If a Hostel Guest opts for a flexible rate, they may cancel their accommodation at no additional cost up to 24 hours before the scheduled arrival date. In the event of a later cancellation, 100% of the accommodation cost will be charged.
Cancelling the reservation within 24 hours before arrival (local hostel time), or failing to show up, will result in a charge for the entire stay, which will be applied to the customer's credit card.
If the Hostel Guest opts for a non-flexible rate, in the event of cancellation, 100% of the accommodation costs will be charged.
ARTICLE 8. GROUP BOOKINGS
Bookings for 13 or more people will be considered group bookings.
Group rates vary depending on different factors (group size, stay dates, availability, etc.) and are provided upon request by phone or email to our groups department at groups@latroupe.com.
The accommodation price must be paid in advance. 30% of the total amount will be paid at the time of booking confirmation, and the remaining 70% will be paid 15 days before the expected arrival date.
Without prejudice to Article 7 of the General Conditions, the following cancellation and refund policy applies to group bookings:
- Cancellation made more than 30 days before the arrival date: the deposit is not refunded. Cancellation fee: 30%.
- Cancellation made less than 30 days before the arrival date: 100% of the booking will be charged.
A request to reduce the duration of the booked stay will be considered a cancellation of the entire reduced period.
Groups must pay a security deposit. LATROUPE will block the deposit amount at check-in via the Group leader's credit card. The deposit block will be released at the end of the stay if hostel guests have paid all outstanding balances and no damage, theft, or irregularities were found in relation to their stay at the Hostel. Otherwise, LATROUPE is entitled to deduct outstanding balances or credits from the blocked amount. LATROUPE will inform the Hostel Guest of this charge.
ARTICLE 9. NO PET POLICY
No pets are allowed, with the exception of guide dogs.
ARTICLE 10. NO SMOKING POLICY
Smoking is prohibited throughout our buildings.
ARTICLE 11. VISITS
Without prejudice to the provisions of the House Rules, Hotel guests may receive visitors in the Hotel's common areas. Visitors are prohibited from accessing guests' rooms and dormitories.
ARTICLE 12. CLEANING
The cleaning policies of our hostels vary depending on the property.
When leaving the room, Hostel guests must collect or store personal items as much as possible. For optimal room cleaning, cleaning company employees are entitled to move any personal items that remain.
ARTICLE 13. USE OF HOTEL FACILITIES
LATROUPE provides various services to the Hostel Guest. Excessive use of these services will be charged to the Hostel Guest. Among other things, charging bicycles and other electric vehicles is prohibited, except in places provided and/or authorised by LATROUPE.
ARTICLE 14. LIABILITY
Hostel guests will inform LATROUPE immediately if damage occurs or if there is a threat of damage occurring in hostel rooms or dormitories. Hostel guests are responsible for any nuisance and damage caused directly or indirectly by themselves or their guests or visitors, except where the damage is the result of normal use.
Hostel guests may not make changes to the hostel room(s) or shared dormitory beds, make holes, use nails or screws, or apply glue or thumbtacks, etc. to the walls, floors, or ceiling of rooms or dormitories.
LATROUPE will not be held liable for any contractual deficiency if it resulted from force majeure situations for which LATROUPE is not responsible, such as strikes, fires, public sector actions, terrorist threats, etc., in accordance with applicable regulations.
If damage or loss occurs due to a fault on the part of a LATROUPE service provider, compensation for Hostel guests' damage or loss will be limited to the compensation that LATROUPE receives from the service provider involved. In any event, LATROUPE's liability will be limited to the value of the contract or compensation to be paid to LATROUPE by a third party or insurance company as compensation for the damage or loss incurred.
For any damage or loss of their items, Hostel guests must prove that it occurred on the Hotel premises and that it was the result of certain actions or omissions on the part of LATROUPE or its service providers. Otherwise, LATROUPE or its assigned service provider will not be held liable for damage, loss, or theft.
LATROUPE is not responsible for damage or loss for which Hostel guests are insured or should have been insured. Guests are personally responsible for the persons they allow to access the Hostel. LATROUPE is not responsible for damage or loss caused by these individuals, or for damage or nuisance caused by objects guests may have brought to the premises. Hostel guests are responsible for any damage caused by their own actions or negligence (whether unlawful or not), or by their guests and visitors. The same applies to animals for which Hostel guests or their guests and visitors are responsible. All damage caused by the Hostel Guest will be charged to them immediately by LATROUPE.
Without prejudice to the foregoing, LATROUPE is responsible for damage or loss of items that Hostel guests have entrusted to LATROUPE for safekeeping upon payment for said service. However, compensation for damage or loss will be limited to the market value of the items in question. LATROUPE is not responsible for the contents of entrusted items. For example, the contents of a wallet will only be compensated if the guest informed LATROUPE in writing at the time of handing it over for safekeeping. LATROUPE is not responsible for items not handed over for safekeeping upon payment for said service.
ARTICLE 15. ACCESS TO HOTEL ROOMS AND DORMITORIES
In the context of daily cleaning, as well as in the event of an emergency, LATROUPE will always have access to hostel rooms and dormitories. Access will also be granted for security reasons or in the case of a well-founded suspicion that a Hostel Guest is engaging in illegal practices or actions that violate the General Conditions and/or House Rules. Staff may enter a room with a "Do Not Disturb" sign after 24 hours.
ARTICLE 16. IMPOSSIBILITY OF PERFORMANCE / FORCE MAJEURE
Except in cases of force majeure, LATROUPE will offer the Hostel Guest alternative accommodation in the same location if it is unable to fulfil the agreement with the Hostel Guest. The associated costs are at the guest's expense, with explicit exclusion of compensation charges and/or costs.
In the event of force majeure, LATROUPE is entitled to suspend the performance of the contract without the Hostel Guest being able to demand any compensation from LATROUPE.
Force majeure includes, among other things, strikes, fires, public sector actions, terrorist threats, storms, floods or water damage, and general interruption of electricity, water, gas, or Internet.
ARTICLE 17. HOUSE RULES
LATROUPE has drafted the House Rules in accordance with applicable regulations to ensure the peaceful enjoyment of all Hostel guests.
The House Rules are an integral part of these General Conditions, and by signing them, the guest declares their agreement with them and undertakes to comply with the regulations incorporated therein and to behave with due diligence.
ARTICLE 18. TERMINATION OF CONTRACT BY LATROUPE
LATROUPE is entitled to unilaterally terminate the contract and all included services at the Hostel Guest's expense in the event of a breach of these General Conditions or the House Rules by the Hostel Guest. This without prior notice of default and without any compensation for the Hostel Guest.
In such cases, payment for the entire stay must be made. Furthermore, LATROUPE reserves the right to recover all direct and indirect damages resulting from the Hostel Guest's breach of the General Conditions or House Rules.
ARTICLE 19. INSURANCE
LATROUPE insures the premises for its full replacement value with an approved insurance company and for the entire duration of the contract, covering at least the following risks: fire, flood, storm, earthquake, water damage, explosions, electrical risks, etc.
The Hostel Guest is responsible, where applicable, for having insurance to protect their personal belongings.
ARTICLE 20. RATES AND TAXES
All taxes and fees, except the municipal tourism tax owed to the city, are at LATROUPE's expense.
ARTICLE 21. ENTIRE AGREEMENT
The booking confirmation, these General Conditions, the House Rules, and any other annexes contain the entire agreement entered into between the parties. It replaces all prior negotiations and agreements.
ARTICLE 22. PERSONAL DATA PROTECTION
LATROUPE and the Hostel Owner will process Hostel guests' data in accordance with the General Data Protection Regulation (GDPR) as data controllers. Please refer to the Hostel Owner's contact details in the Legal Notice of this website. The companies have designated a Data Protection Officer who can be contacted at the following email address: latroupe@akela.legal
LATROUPE and the Hostel Owner will process the data you provide as a result of the management, processing, and development of the contractual relationship, whether required by law or necessary for the formalisation of the contract, including identification and contact data, personal characteristics, social circumstances, or economic and financial data, among others. Hostel guest data may be processed to assess certain personality aspects, in particular to analyse or predict aspects related to professional performance, economic situation, personal preferences, interests, reliability, behaviour, location, or movements of that natural person. No automated individual decisions will be made based on this data processing.
Hostel guest data will be processed primarily to manage the booking and provide the agreed hotel services, including in particular:
- Introduction, management, and control of the contractual relationship between the Hostel Guest and LATROUPE.
- Management and resolution of requests that Hostel Guests have regarding LATROUPE services.
- Conducting periodic surveys to gauge the level of satisfaction of Hostel Guests with the service received from LATROUPE staff or collaborators. The responses provided by Hostel Guests in the survey are completely anonymous, so the information provided by you cannot be linked to you personally.
- Sending personalised advertising information about activities, products, services, events, special promotions, as well as documentation of various kinds, via postal mail, telephone, or electronic means (email, SMS, instant messaging, etc.). The information to be sent may be exclusively related to LATROUPE and the Hostel Owner and will concern products or services similar to those previously contracted, or events in which LATROUPE or these companies participate that are similar to those you have contracted. The information may be sent even based on the analysis and evaluation of your profile, which will be carried out using internal data.
The data processing for the management of the legal relationship is based on the necessity of performing a contract to which the data subject is a party, or to take steps at the request of the data subject prior to entering into a contract. Additionally, the marketing purpose related to LATROUPE's products, services, and events derives its lawfulness from the legitimate interest pursued by LATROUPE and the Hostel Owner. This data processing will be proportionate due to the legitimate manner in which users' contact data and information have been obtained, the sending of information only about products or services of the entity contracted and similar to those contracted, and the fact that the opportunity to object to these communications will always be provided.
Personal data of Hostel guests may be shared with the following recipients based on the legitimising basis for the communication:
- Public Authorities, Security Forces and Bodies, or Courts, under the terms established in applicable regulations, exclusively when such data communication is truthful and/or in fulfilment of legal obligations arising from claims, proceedings, or any administrative or judicial procedure.
- Banking and financial entities to enable the management of payments and economic transactions arising from the contractual relationship.
- Third parties that carry out the following functions for LATROUPE, among others: management, control, document management, regulatory compliance monitoring, or auditing, for the provision of services required by applicable regulations.
- Third parties contracted by LATROUPE to provide services proactively requested by the Hotel Guest related to possible incidents at the Hotel.
The personal data provided will be stored for the duration of the contractual relationship. Once the relationship ends, the data will be retained for the time necessary to fulfil the purpose for which it was collected and for the legally required time to address any liabilities that may arise from that data processing and that purpose.
LATROUPE informs you that you have the following rights regarding your personal data:
- Right to request access to your personal data. Firstly, you have the right to obtain confirmation of whether or not LATROUPE is processing data concerning you and, if so, the right to access such personal data.
- Right to modify, delete, and erase your personal data. You also have the right to request the modification of inaccurate data or, where applicable, to request its deletion when, among other reasons, the data is no longer needed for the purpose for which it was collected.
- Right to restriction of processing of your personal data. In certain circumstances, you may also ask LATROUPE to restrict the processing of your data, in which case it will only be retained for the presentation or defence of claims.
- Right to data portability. You have the right to have LATROUPE send your data to another organisation, provided you request it.
- Right to object. In certain circumstances and for reasons related to your particular situation, you may object to the processing of your data. LATROUPE will cease processing your data, except for legal reasons or for the defence of potential claims.
- Right to withdraw consent. We remind you that you have the right to object to the processing of your data for commercial or advertising purposes, as well as to withdraw any consents you have given for data processing, without this affecting the lawfulness of the processing carried out on that basis.
- Automated individual decisions. You have the right not to be subject to a decision that individually affects you based solely on automated processing, including profiling, which produces legal effects or similarly significantly affects you.
Hotel guests may exercise their rights by means of a written document identified with the reference "Data Protection" accompanied by their national ID or equivalent document, which must be sent to Calle Villanueva 2B, Escalera 1, Planta SM, 28001 Madrid or latroupe@akela.legal. If you consider that we have not respected the exercise of your rights, you may contact the Data Protection Officer (latroupe@akela.legal) or lodge a complaint with the competent supervisory authority.
ARTICLE 23. AMENDMENTS
LATROUPE may amend these General Conditions at any time. The General Conditions in force at the time of booking by the Hostel Guest are binding between the parties.
The House Rules may also be subject to changes. If these changes occur during the stay, LATROUPE will inform the Hostel Guest by email. Amendments to the House Rules will take effect immediately upon notification to the Hostel Guest. Any modification or addition to the agreement between the Hostel Guest and LATROUPE must be made in writing.
ARTICLE 24. DOCUMENT RETENTION
LATROUPE must retain the Hostel Guest's booking documentation for a minimum period of five years, or for the duration of its commercial lifespan, even if this exceeds the 5-year period. The Hostel Guest may access this information by contacting LATROUPE.
ARTICLE 25. APPLICABLE LAW AND DISPUTES
This agreement is subject to Spanish law and any dispute between the parties related to the interpretation or performance of this agreement will be definitively resolved before the courts of Spain, unless the law provides otherwise.
ARTICLE 26. INVALIDITY
In the event that any clause of this contract is declared null, voidable, or similar, the effect of the invalidity will be limited to the affected clause(s). The remaining conditions of the contract will remain valid. In the event of the invalidity or unenforceability of a provision of this contract, the parties undertake to replace said provision with a valid provision that is as beneficial as possible for the parties.
ARTICLE 27. LANGUAGE
In the event of any doubt regarding the interpretation of the conditions of this contract, all conditions will be interpreted in the language in which they are written, with Spanish being the primary valid language.
ARTICLE 28. HEADINGS
The subtitles and headings appearing in this agreement are purely indicative and do not express the parties' agreement. They will not be taken into account for the interpretation of the provisions of this agreement.
HOUSE RULES
The LATROUPE team has drawn up the following document to ensure that your stay and that of other guests at LATROUPE proceeds smoothly. We thank you for reading these rules carefully and thoroughly. For more information or queries, you may approach our staff at reception.
Thank you in advance for your cooperation!
ARTICLE 1. GENERAL
By confirming your booking, you expressly accept the House Rules and undertake to comply with them and to act with due diligence. You must not disturb and will respect other Guests, as well as staff, local residents, and the property.
Any guest who, in the opinion of our staff, compromises the comfort, safety, or security of other guests, staff, or local residents, will be asked to leave the Hostel premises, in which case all charges will be immediately payable by them.
ARTICLE 2. RECEPTION
Reception is open every day, 24 hours a day, 7 days a week, 365 days a year. The staff on duty are at your disposal and will respond to your questions and concerns as soon as possible.
Valid photo identification is required during the Check-in process (national identity document, passport, or driving licence). It must be an official document; a driving licence will not be accepted as valid.
Hotel guests may check in and check out during the following hours (see Article 5 of the General Conditions):
- On the first day of your stay from 3:30 PM.
- On the last day of your stay until 11:00 AM.
ARTICLE 3. RESPECT FOR OTHER GUESTS AND LATROUPE STAFF
Respect is a core concept at LATROUPE. Therefore, we ask that you always treat your fellow guests, as well as LATROUPE staff, with the required respect. Intimidation and violence are not tolerated.
ARTICLE 4. COMMON AREAS, GATHERINGS, AND NOISE DISTURBANCES
Peaceful enjoyment during the day and a good night's rest for all guests is a priority for LATROUPE.
You have free access to the common areas. Additionally, in some of our hostels, a shared kitchen and dining area, as well as a lounge, have been provided.
LATROUPE strongly encourages making use of the common area facilities, as they are, so to speak, an extension of your private accommodation and serve as a meeting place for you and other guests.
We ask that you observe several specific rules for each area to allow guests to use the common areas in the most optimal and pleasant way possible. Usage rules are displayed separately and clearly in each area. These rules are part of these House Rules and you and your guests must always comply with them.
In any case, we ask that you always leave the common areas clean and tidy. Otherwise, LATROUPE will charge you the full cleaning costs. In addition, you will be charged all costs for damage caused by you. Compensation includes the total repair costs or compensation as estimated by an expert or contractor appointed by the parties, with a minimum flat fee for damage of €250.00.
Your guests and visitors are welcome in LATROUPE's common areas. To avoid disturbances and for fire safety reasons, we ask that you inform LATROUPE reception before you wish to organise a gathering with more than five external guests.
Outside the premises, municipal and state regulations apply.
ARTICLE 5. EMERGENCY EXITS
In the event of a fire, the required emergency exits are provided and displayed throughout the premises.
Do not leave any items near emergency exits. These emergency exits must always be free and fully accessible. Furthermore, it is strictly prohibited to use emergency exits without an emergency.
Where expressly indicated, fire and emergency doors must always remain closed. A penalty of €150.00 will be charged immediately for blocking or using emergency exits without an emergency. This will be considered a breach of the House Rules, which means LATROUPE may, in accordance with the General Conditions, unilaterally terminate the contract with the Hostel Guest.
ARTICLE 6. NO SMOKING AND FIRE ALARM
Smoking is prohibited throughout the building, both in common areas and in rooms. This prohibition also applies to electronic cigarettes. The use of fire or candles in rooms, as well as in common areas, is also strictly prohibited. In general, it is prohibited to bring flammable, explosive, or dangerous liquids or products into the premises.
If you are caught smoking, using lit candles, tampering with smoke detectors, or using fire extinguishers inappropriately, a penalty of €150.00 will be charged immediately. This is also a breach of the House Rules, which means LATROUPE may, in accordance with the General Conditions, unilaterally terminate the contract with the Hostel Guest.
ARTICLE 7. ILLEGAL SUBSTANCES, DRUGS, AND WEAPONS
The introduction of illicit substances, drugs, and weapons onto the premises is strictly prohibited and will entitle LATROUPE to immediately and unilaterally terminate the contract in accordance with the General Conditions. Furthermore, LATROUPE will inform the competent authorities and a penalty of €150.00 will be charged immediately.
ARTICLE 8. LOBBY
LATROUPE wishes to welcome you in the lobby every day. The lobby is accessible to all hotel guests and their visitors. Regarding the invitation of external persons, LATROUPE refers to the explanation under "Gatherings and noise disturbances."
Since the lobby must be a space for relaxing and enjoying for every guest, we thank you for keeping it clean and tidy and for making correct use of the furniture provided.
ARTICLE 9. USE OF THE WI-FI NETWORK
During your stay you may use the LATROUPE Wi-Fi network. Since the Wi-Fi network is accessible to all guests and visitors, we recommend that you install antivirus software and a firewall on all your devices.
It is strictly prohibited to visit pornographic or illegal websites, to infringe intellectual property rights, or to disseminate confidential or sensitive information. In general, obviously, any punishable offence is unacceptable.
To ensure the quality of the Wi-Fi network, using or installing private networks or routers is not permitted. LATROUPE does everything necessary to always ensure the operation and access to the Wi-Fi network. However, (temporary) unavailability due to technical or other disruptions cannot be excluded. Use of LATROUPE's Wi-Fi network is at your own risk. LATROUPE is not responsible for damages, losses, or costs arising from the unavailability of the Wi-Fi network.
ARTICLE 10. LOST PROPERTY
Always check carefully that you have not left anything behind when leaving your room or the premises. We also strongly ask that you do not leave any valuables at the Hostel.
Items found in rooms or common areas of the building will be retained by LATROUPE for three months after check-out. If you left or lost something, you can contact LATROUPE reception with a description of the lost item during your stay, as well as up to three months afterwards. If the item was found, LATROUPE will attempt to return it to you safely. After the three-month period, LATROUPE becomes the owner of these items. Lost items may be collected at the Hostel by the owner with an accepted form of identification.

Luggage storage service. Depending on the property, LATROUPE will have self-service electronic lockers where guests can store their belongings. The rate varies depending on the size of the luggage and the number of hours it is stored.
