GENERAL CONDITIONS OF THE HOSTELS

This document constitutes the General Conditions of the hostels managed by SMART HOPER, S.L.U. (hereinafter, “LATROUPE”). The General Conditions contain all the information that you (hereinafter, “Hostel guest” or “Hostel guests”) must know and comply with.

ARTICLE 1. RESERVATION CONFIRMATION

Once each reservation has been successfully completed, you, as a Hostel guest, will receive a reservation confirmation with your details and all the relevant information. This reservation confirmation represents the agreement between the Hostel guest and LATROUPE, along with these General Conditions, the House Rules, and any other annexes.

ARTICLE 2. ROOMS AND COMMON AREAS AT LATROUPE

For Hostel guests, LATROUPE offers the following accommodation options, depending on availability:

  • Double Room: Private room for two people with a private bathroom and shower.
  • Family Room: Private family room for three or four people with a private bathroom and shower.
  • Multiple Room: Shared/private dormitory for 4, 5, 6, 7, 8, 10, or 12 people with ensuite or shared bathroom (depending on the property).

The following amenities are included in each accommodation option: reception, cleaning, air conditioning, WiFi, and a hairdryer available at reception.

Towel and bed linen changes are included in double and family rooms. In shared dorms, towels are available for an additional fee, and used towels must be placed in the designated bins at the reception area upon checkout.

Hostel guests have free access to the common areas of the facilities.

Hostel guests must respect the House Rules when using the common areas and the provided amenities. Hostel guests will be immediately charged for any misuse or excessive use of these amenities.

ARTICLE 3. RATES

LATROUPE offers two rate options: flexible and non-flexible.

  • Flexible Rate:

    • The total amount must be paid at least 24 hours before the scheduled arrival date.
    • Cancellations or modifications are possible up to 24 hours before arrival (see Article 7).
  • Non-Flexible Rate:

    • The total amount will be charged at the time of booking and must be paid immediately.
    • In case of cancellation, a 100% cancellation fee applies (see Article 7).

A city tax is added to the prices. The amount of this tax depends on the number of guests and the number of nights booked.

The prices of the accommodation options mentioned in Article 2 can be checked at any time on the LATROUPE website. All amounts are in EUROS.

The amount owed by the guest must be paid through the provided online payment system.

The prices listed on the website are subject to change. Only the rates in effect at the time of booking will apply to the agreement between the Hostel guest and LATROUPE.

Obvious errors (including typographical errors) are not binding.

All special offers and promotions are clearly marked as such. If they are not labeled as such, hostel guests cannot claim them in case of errors or omissions.

Article 8 of these General Conditions applies to group bookings.

ARTICLE 4. ROOM ASSIGNMENT

During the check-in process, LATROUPE unilaterally assigns a room to the Hostel guest within the selected accommodation option. Hostel guests cannot oppose this assignment.

LATROUPE reserves the right to assign a different room to a Hostel guest before or during their stay for operational reasons. Hostel guests cannot oppose this or claim any compensation from LATROUPE.

ARTICLE 5. CHECK-IN AND CHECK-OUT

  • Check-in is available from 3:30 p.m. on the first day of the reservation.
    • In case of early arrival, LATROUPE cannot guarantee room availability.
  • Check-out must be completed before 11:00 a.m. on the last day of the reservation.
    • Late check-out (maximum two extra hours) incurs an additional fee, which varies depending on whether the guest stays in a shared dorm or a private room.
    • After the designated check-out time, a full night's rate will be charged.

If a guest checks out before the scheduled departure date, LATROUPE has the right to charge the total number of reserved nights according to the price stated in the reservation confirmation.

A guest can stay in a dormitory for a maximum of 10 consecutive days. After this period, they must either leave LATROUPE or make a long-term booking with prior approval from LATROUPE management.

ARTICLE 6. KEY CARD

Upon check-in, each Hostel guest will receive an activated key card.

  • Additional key cards can be requested for €10 per card.
  • In case of loss, damage, or failure to return the key card at check-out, a €5 penalty will be charged.

ARTICLE 7. CANCELLATION POLICY

  • Flexible Rate:

    • Guests can cancel their stay free of charge up to 24 hours before the scheduled arrival date.
    • If canceled less than 24 hours before arrival or in case of a no-show, 100% of the stay will be charged.
  • Non-Flexible Rate:

    • 100% of the stay will be charged for cancellations.

ARTICLE 8. GROUP BOOKINGS

Bookings of 13 or more people are considered group bookings.

  • Group rates vary depending on factors such as group size, stay dates, and availability. Rates are provided upon request via email at groups@latroupe.com.
  • Payment must be made in advance:
    • 30% deposit at the time of booking confirmation.
    • Remaining 70% due 15 days before arrival.

Cancellation policy for groups:

  • Cancellations more than 30 days before arrival: 30% cancellation fee (no deposit refund).
  • Cancellations less than 30 days before arrival: 100% of the booking is charged.

A security deposit is required for group bookings. LATROUPE will block the deposit amount on the group leader’s credit card at check-in.

  • If no damages, outstanding balances, or irregularities occur, the deposit will be released at check-out.
  • Otherwise, LATROUPE may deduct pending charges from the blocked amount.

ARTICLE 9. PET POLICY

Pets are not allowed in the hostel, except for guide dogs.

ARTICLE 10. SMOKING POLICY

Smoking is strictly prohibited in all our buildings.

ARTICLE 11. VISITORS

  • Hostel guests may receive visitors in the hostel’s common areas, subject to the House Rules.
  • Visitors are not allowed in hostel rooms or dormitories.

ARTICLE 12. CLEANING

The cleaning policies vary depending on the property.

  • Guests must keep their rooms tidy and store personal belongings properly.
  • To ensure optimal room cleaning, housekeeping staff has the right to move personal belongings if necessary.

ARTICLE 13. USE OF HOSTEL FACILITIES

LATROUPE provides various services for Hostel guests.

  • Excessive use of these services will result in additional charges.
  • Charging e-bikes and other electric vehicles is strictly prohibited, except in designated or authorized areas.

ARTICLE 14. LIABILITY

  • Hostel guests must immediately report any damage or potential damage to LATROUPE.
  • Guests are responsible for any disturbances or damages they cause, whether directly or indirectly.
  • Guests cannot modify hostel rooms, walls, floors, or ceilings by nailing, screwing, gluing, or painting.

LATROUPE is not responsible for damages or losses due to force majeure, such as strikes, fires, government actions, or terrorist threats.

If damage or loss is caused by a LATROUPE service provider, compensation is limited to the amount LATROUPE receives from the service provider.

Guests must prove any damage or loss that occurred on the hostel premises due to LATROUPE's fault. Otherwise, LATROUPE is not responsible for theft, loss, or damage.

LATROUPE is not responsible for damages or losses covered by a guest's insurance policy.

Guests are personally responsible for people they allow into the hostel. LATROUPE is not responsible for damages caused by third parties.

Valuables deposited with LATROUPE for safekeeping are only covered for their market value. LATROUPE does not compensate for the contents of lost wallets, bags, or other valuables unless specifically declared in writing.

ARTICLE 15. ACCESS TO ROOMS AND DORMITORIES

LATROUPE reserves the right to access rooms and dormitories in the following cases:

  • Daily cleaning
  • Emergencies
  • Security concerns
  • Suspicion of illegal activities or violations of hostel policies

If a “Do Not Disturb” sign is placed, staff may enter after 24 hours.

ARTICLE 16. FORCE MAJEURE / SERVICE INTERRUPTION

  • In case of service interruption, LATROUPE will offer alternative accommodation in the same city, but guests will bear the cost.
  • LATROUPE is not liable for service interruptions due to strikes, fires, floods, storms, power outages, or government actions.

ARTICLE 17. HOUSE RULES

The House Rules are an integral part of these General Conditions. By signing, guests agree to comply with these rules.

ARTICLE 18. CONTRACT TERMINATION BY LATROUPE

LATROUPE has the right to unilaterally terminate the contract and remove a guest from the hostel in case of:

  • Violation of General Conditions
  • Violation of House Rules

No refunds will be issued, and LATROUPE reserves the right to claim compensation for damages.

ARTICLE 19. INSURANCE

LATROUPE holds comprehensive insurance covering risks such as fire, flood, storms, and electrical failures.

Guests are responsible for insuring their personal belongings.

ARTICLE 20. TAXES AND FEES

All taxes and fees are included except for the city tourism tax, which must be paid separately.

ARTICLE 21. COMPLETE AGREEMENT

The reservation confirmation, General Conditions, and House Rules constitute the entire agreement between the parties, replacing all prior negotiations.

ARTICLE 22. DATA PROTECTION

LATROUPE and the hostel owner process guest data in compliance with GDPR.

  • Guest data is used to manage bookings and services, including surveys and promotional communications.
  • Personal data may be shared with:
    • Authorities, law enforcement, and courts (if legally required).
    • Banks and financial institutions (for payments).
    • Third-party service providers (for operational support).

Guest rights include:

  • Access, modification, and deletion of personal data.
  • Objection to marketing communications.
  • Withdrawal of consent at any time.

ARTICLE 23. MODIFICATIONS

LATROUPE may modify these General Conditions at any time. The version in effect at the time of booking applies.

If House Rules change during a guest’s stay, they will be notified by email.

ARTICLE 24. DOCUMENT RETENTION

LATROUPE must retain guest reservation records for a minimum of five years.

ARTICLE 25. GOVERNING LAW AND DISPUTES

This contract is governed by Spanish law. Any disputes will be settled in Spanish courts, unless otherwise required by law.

ARTICLE 26. SEVERABILITY

If any clause of this contract is declared invalid, the rest of the agreement remains in effect.

ARTICLE 27. LANGUAGE

In case of interpretation disputes, the Spanish version prevails.

ARTICLE 28. HEADINGS

Headings in this document are for reference only and do not affect interpretation.


HOUSE RULES

LATROUPE has established the following rules to ensure a smooth stay for all guests.

ARTICLE 1. GENERAL

By confirming your reservation, you agree to comply with the House Rules.

  • Guests must respect others, staff, and local residents.
  • Any guest compromising comfort, security, or safety may be evicted without refund.

ARTICLE 2. RECEPTION

  • Reception is open 24/7.
  • A valid photo ID is required for check-in (passport or national ID).

ARTICLE 3. RESPECT FOR GUESTS AND STAFF

LATROUPE does not tolerate violence or harassment.

ARTICLE 4. COMMON AREAS AND NOISE

  • Guests must keep common areas clean.
  • Quiet hours apply at night.
  • LATROUPE may charge a minimum fee of €250 for cleaning or damage.

ARTICLE 5. EMERGENCY EXITS

  • Emergency exits must remain clear.
  • Unauthorized use of emergency exits incurs a €150 penalty.

ARTICLE 6. SMOKING AND FIRE ALARMS

  • Smoking (including e-cigarettes) is prohibited.
  • Tampering with fire alarms incurs a €150 fine.

ARTICLE 7. ILLEGAL SUBSTANCES AND WEAPONS

  • Drugs and weapons are strictly prohibited.
  • Violations result in immediate eviction, a €150 fine, and police notification.

ARTICLE 8. LOBBY

Guests must keep the lobby clean and use furniture appropriately.

ARTICLE 9. WIFI USAGE

  • Guests must not access illegal content.
  • LATROUPE is not responsible for WiFi disruptions.

ARTICLE 10. LOST ITEMS

  • Found items are kept for three months.
  • LATROUPE is not responsible for lost or stolen items.

ARTICLE 11. RESPONSIBILITY

ARTICLE 12. PRIVACY POLICY

LATROUPE’s Privacy Policy is available on www.latroupe.com.

ARTICLE 13. SERVICES

  • Printing is free (limited pages).
  • Luggage storage, laundry, and towels are available for a fee.

ARTICLE 14. MINORS

  • Guests under 18 must be accompanied by an adult.
  • Guests under 16 must stay in a private room.

ARTICLE 15. ALCOHOL POLICY

  • Alcohol is not served to minors.
  • Bringing alcohol incurs a €100 fine.

ARTICLE 16. PAYMENT METHODS

  • Online reservations require a credit card.
  • Cash is accepted for walk-in bookings.
